Terms of Use

These Terms of Use govern access to and use of BarnBuys, including the BarnBuys website and mobile application. By accessing or using BarnBuys, you agree to these Terms. If you do not agree, do not use the service.

Informational Purpose

BarnBuys provides farm stand and agricultural retail information for general informational purposes. Listing details may change and are not guaranteed to be complete, current, or accurate.

Users should confirm important details directly with the farm operator before travelling, entering property, or making a purchase.

User Submissions

Users may submit farm stand locations, descriptions, products, photographs, contact details, operating hours, website links, reports, ownership claims, and other listing information.

By submitting content, you confirm that you have the right and any necessary permission to provide it and that it is accurate to the best of your knowledge. You must not submit content that is intentionally false, misleading, unlawful, infringing, defamatory, harmful, inappropriate, or unrelated to the listing.

You retain ownership of content you submit. You grant BarnBuys a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, store, format, adapt for display, publish, and distribute that content as reasonably necessary to operate, promote, secure, and improve BarnBuys and its listings.

This licence ends when the content is removed from BarnBuys, except to the extent it has already been shared, remains in backups for a limited period, or must be retained for legal, safety, fraud-prevention, or operational reasons.

Submission does not guarantee publication. BarnBuys may review, verify, edit for formatting or clarity, reject, unpublish, restrict, replace, or remove a submission, photograph, or listing at its discretion. This may occur when information cannot be verified or may create an accuracy, safety, privacy, security, or legal concern.

BarnBuys may remove photographs or listing content that is inaccurate, outdated, misleading, inappropriate, unlawful, infringing, unsafe, or no longer representative of the farm stand.

Farm Photos

Photographs submitted by regular users may be reviewed before publication. BarnBuys may approve, reject, remove, or request changes to submitted photographs.

Verified farm owners and BarnBuys administrators may add or remove photographs from approved farm listings. Photographs added by verified farm owners or administrators may be published without the same review process applied to regular user submissions.

Anyone uploading a photograph confirms that they own the photograph or otherwise have permission to upload and publish it. Photographs must not violate another person's copyright, privacy, publicity, property, or other legal rights.

Farm Operator Requests and Verified Ownership

Farm operators, property owners, and their authorized representatives may request corrections, updates, ownership verification, or removal of a listing through the BarnBuys contact form or by contacting support@barnbuys.ca .

By submitting an ownership claim, you confirm that you are the owner, operator, or an authorized representative of the farm stand. BarnBuys may request reasonable information to verify the claim and may approve, reject, suspend, or revoke a claim when appropriate.

Do not impersonate another person or business or submit documents, photographs, contact information, or other material that you are not authorized to provide.

Verified farm owners are responsible for ensuring that the photographs and listing information they upload are accurate, lawful, current, and reasonably represent their farm stand.

Verified status does not guarantee that BarnBuys endorses a farm, its products, its business practices, or the accuracy of every statement made by the verified owner.

Visiting Listed Locations

Users are responsible for following posted signs, respecting private property, obeying traffic laws, parking safely, and confirming that a farm stand is open before visiting.

A map pin or route does not grant permission to enter private property, restricted areas, farm fields, buildings, driveways, or other non-public areas.

BarnBuys is not responsible for travel decisions, navigation, property access, purchases, product quality, injuries, losses, interactions with third parties, or conditions at a listed location.

Directions and Third-Party Navigation

BarnBuys may provide an approximate route preview or allow you to open a destination in Apple Maps or another supported mapping application.

Routes, distances, travel times, road conditions, closures, access points, and navigation instructions are provided by mapping services and may be incomplete, delayed, or inaccurate.

You are responsible for following traffic laws, posted signs, road conditions, and safe-driving practices. Do not interact with BarnBuys while driving unless permitted by law and safe to do so.

Acceptable Use

Users must not:

• Misuse BarnBuys or interfere with its operation.
• Attempt unauthorized access to an account, database, server, administrative feature, or other part of the service.
• Submit fraudulent, misleading, harmful, unlawful, infringing, or inappropriate content.
• Impersonate another person, farm, organization, or business.
• Falsely claim ownership or authorization over a farm listing.
• Upload photographs or content that you do not have permission to use.
• Collect, scrape, or use information about others unlawfully or without authorization.
• Send spam, threats, abuse, harassment, or deceptive messages through the service.
• Use BarnBuys for an unlawful, fraudulent, or harmful purpose.

Accounts

You are responsible for maintaining the security of your account and for activity occurring through it. You must provide accurate account information and notify BarnBuys if you believe your account has been accessed without authorization.

BarnBuys may restrict, suspend, or terminate access when reasonably necessary to protect the service, users, farm operators, or the public; investigate misuse; comply with law; or enforce these Terms.

You may request account deletion through the app or by contacting support. Certain information may be retained when reasonably necessary for legal, security, fraud-prevention, backup, dispute-resolution, or operational purposes.

Reports and Moderation

Users may report listings or content that they believe is inaccurate, inappropriate, unsafe, unlawful, or otherwise problematic.

Submitting a report does not guarantee that content will be removed. BarnBuys may investigate and take any action it considers appropriate, including making corrections, requesting additional information, restricting content, removing content, suspending an account, or taking no action.

Reports must be submitted honestly and must not be used to harass a farm operator, user, business, or other person.

Third-Party Services

BarnBuys may link to or work with third-party maps, websites, farms, email providers, hosting providers, sign-in providers, and other services. This includes Apple Maps when you choose to start navigation from within BarnBuys.

BarnBuys does not control those third parties and is not responsible for their content, availability, directions, products, services, security, or privacy practices.

Your use of a third-party service may be governed by that provider's terms and policies.

Intellectual Property

BarnBuys and its original branding, design, software, graphics, text, logos, and other materials are owned by BarnBuys or used with permission and are protected by applicable intellectual property laws.

These Terms do not grant you ownership of BarnBuys or permission to copy, reproduce, distribute, reverse engineer, or create derivative works from protected BarnBuys materials except where permitted by law.

Disclaimer and Limitation of Liability

BarnBuys is provided on an “as is” and “as available” basis to the extent permitted by law.

BarnBuys does not guarantee that the service will always be available, secure, uninterrupted, error-free, or that every listing, photograph, route, distance, product description, operating hour, or other piece of information will be accurate or suitable for a particular purpose.

To the extent permitted by law, BarnBuys will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from use of the service, reliance on a listing, navigation or travel decisions, visits to a listed location, purchases from a third party, user-submitted content, or unauthorized access to the service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, and reasonable costs resulting from content you submit, your misuse of BarnBuys, your violation of these Terms, or your infringement of another person's rights.

Changes and Availability

BarnBuys may add, update, suspend, restrict, or discontinue features at any time. During testing or beta distribution, features may be incomplete, experimental, unavailable, or changed without notice.

These Terms may also be updated as the service develops. The effective date at the top of this page will show when the Terms were most recently revised.

Continuing to use BarnBuys after updated Terms take effect means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada.

Any dispute will be handled by the courts with jurisdiction in Ontario, unless applicable law requires otherwise.
